Couple Arrested and Brutalized for Not Letting the Police Use Their Home to Spy on Neighbors

No soldier shall, in time of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner to be prescribed by law.

The Henderson Nevada PD arrested a family for refusing to let officers use their home as a lookout location. Seems the police had a domestic violence investigation of their neighbor, and thought it would be handy to just commandeer the Mitchell family home next door.

The Mitchell family has filed a lawsuit and claims 3rd Amendment violations, a rare claim in the United States. The 3rd Amendment prohibits quartering soldiers in citizens' homes in times of peace without the consent of the owner.

Among the claims is even though victim/homeowner Anthony Mitchell was face down on the ground and posed no threat, they still fired multiple 'pepperball' rounds as he lay defenseless on the floor of his living room. He was shot at least 3 times at close range, injuring him and causing him severe pain.
